1. Introduction

This Privacy Policy applies to you, the user of this website, and HumanSkills.ai LLC (“we,” “us,” “our”), the owner and provider of this website. This Policy governs our use of any and all data collected by us in relation to your use of the website, the AI Agility course, and any services or systems provided through them, including the Virgil AI coaching assistant.
About Virgil: Virgil is an AI-powered coaching assistant integrated into our AI Agility courses. Use of Virgil is entirely voluntary. Every coaching exercise includes a manual alternative that does not involve AI interaction. Choosing not to use Virgil will not affect your ability to complete the course or receive credit.

2. Definitions

In this Policy, the following terms shall have the following meanings:
“Account” means collectively the personal information, payment information, and credentials used by Users to access material and/or any communications system on the website.
“Content” means any text, graphics, images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that appears on or forms part of this website.
“Cookie” means a small text file placed on your computer by HumanSkills.ai when you visit certain parts of this website, allowing us to identify recurring visitors and analyze their browsing habits.
“Data” means collectively all information that you submit to the website or provide through any service. This includes, but is not limited to, Account details, information submitted using any of our services or systems, and conversations with Virgil.
“Service” means collectively any online facilities, tools, services, or information that HumanSkills.ai makes available through the website either now or in the future, including the Virgil AI coaching assistant.
“System” means any online communications infrastructure that HumanSkills.ai makes available through the website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities, email links, and AI-powered coaching tools.
“User” / “Users” means any third party that accesses the website and is not employed by HumanSkills.ai and acting in the course of their employment.
“Virgil” means the AI-powered coaching assistant integrated into AI Agility courses, which uses Google’s Gemini API to generate personalized coaching responses.
“Website” means the website that you are currently using (upskill.humanskills.ai) and any sub-domains of this site unless expressly excluded by their own terms and conditions.

3. Data Collected

Without limitation, any of the following Data may be collected:

3.1 Website Data

  • Name
  • Job title
  • Contact information such as email addresses
  • Demographic information such as postal code, preferences, and interests
  • Financial information such as credit/debit card numbers
  • IP address (automatically collected)
  • Web browser type and version (automatically collected)
  • Operating system (automatically collected)
  • A list of URLs starting with a referring site, your activity on this website, and the site you exit to (automatically collected)
  • Cookie information (see Section 10 below)

3.2 Virgil Coaching Data

When you use the Virgil AI coaching assistant, the following additional data is collected:
  • Platform identity data: Your user ID, display name, and organization name (if applicable) are passed to Virgil from LearnWorlds to personalize your coaching experience.
  • Conversation data: Everything you type in your conversations with Virgil is collected and stored. This includes questions, responses to coaching prompts, descriptions of your work tasks, and any other information you choose to share during a session.
  • Usage data: Message counts, session timestamps, session duration, and module activity are collected for quality assurance and usage quota management.

4. Our Use of Data

4.1 General Use

Any personal Data you submit will be retained by HumanSkills.ai for as long as you use the services and systems provided on the website. Data that you may submit through any communications system that we may provide may be retained for a longer period of up to one year.

Unless we are obliged or permitted by law to do so, and subject to Section 5, your Data will not be disclosed to third parties. This includes our affiliates and/or other companies within our group.

All personal Data is stored securely in accordance with applicable data protection laws. For more details on security, see Section 8 below.

Any or all of the above Data may be required by us from time to time in order to provide you with the best possible service and experience when using our website. Specifically, Data may be used by us for the following reasons:
  • Internal record keeping
  • Improvement of our products and services
  • Transmission by email of promotional materials that may be of interest to you
  • Contact for market research purposes which may be done using email, telephone, fax, or mail; such information may be used to customize or update the website

4.2 Virgil Coaching Data Use

In addition to the general uses above, Virgil coaching data is specifically used for:
  • Coaching delivery: Your conversation history is maintained during a session so Virgil can provide contextually relevant responses. When you start a new session, your previous conversation may be archived for quality assurance purposes.
  • AI processing: Your messages are sent to Google’s Gemini API to generate coaching responses. Your organization name may be included in the AI prompt to provide industry-relevant coaching. Under our paid API agreement with Google, your conversation data is not used by Google to train, improve, or develop their AI models. Google processes your data solely to generate a response and does not retain it beyond the immediate request processing
  • Quality assurance: We analyze session data to evaluate and improve the coaching experience, including reviewing conversation quality and module coverage.
  • Usage management: We track message counts to manage per-learner usage quotas.

5. Third Party Services and AI Processing

5.1 General Third-Party Services

HumanSkills.ai may, from time to time, employ the services of other parties for dealing with matters that may include, but are not limited to, payment handling, delivery of purchased items, search engine facilities, advertising, and marketing. The providers of such services do not have access to certain personal Data provided by Users of this website. Any Data used by such parties is used only to the extent required by them to perform the services that HumanSkills.ai requests. Any use for other purposes is strictly prohibited. Furthermore, any Data that is processed by third parties must be processed within the terms of this Policy and in accordance with applicable data protection laws.

5.2 AI Processing

Virgil uses Google’s Gemini API, a generative AI service, to produce coaching responses. When you send a message to Virgil, your message and relevant conversation context are transmitted to Google’s servers for processing.
Under our paid API agreement with Google, your conversation data is not used by Google to train, improve, or develop their AI models. Google processes your data solely to generate a response and does not retain it beyond the immediate request processing.

6. Who Has Access to Your Data

Access to your data, including Virgil conversation transcripts, is limited to authorized members of the HumanSkills.ai team for the purposes of system administration, quality assurance, and technical support. Your employer or sponsoring organization does not have access to your individual coaching session transcripts.
We do not sell, rent, or share your personal information with third parties for marketing purposes.

7. Changes of Business Ownership and Control

HumanSkills.ai may, from time to time, expand or reduce its business, and this may involve the sale of certain divisions or the transfer of control of certain divisions to other parties. Data provided by Users will, where it is relevant to any division so transferred, be transferred along with that division and the new owner or newly controlling party will, under the terms of this Policy, be permitted to use the Data for the purposes for which it was supplied by you.

In the event that any Data submitted by Users will be transferred in such a manner, you will be contacted in advance and informed of the changes. When contacted you will be given the choice to have your Data deleted or withheld from the new owner or controller.

8. Data Retention

8.1 Website and Account Data

Personal Data you submit will be retained for as long as you use the services and systems provided on the website. Data submitted through any communications system may be retained for up to one year.

8.2 Virgil Coaching Data

  • Active sessions: Your current conversation is maintained for the duration of your session (up to 24 hours of inactivity).
  • Archived sessions: When a session ends, the conversation may be archived for quality assurance analysis. Archived sessions are retained for up to 12 months.
  • Usage data: Quota and interaction logs are retained for up to 12 months.
You may request earlier deletion of your data by contacting us (see Section 13).

9. Your Rights

9.1 Right to Withhold Information

You may access certain areas of the website without providing any Data at all. However, to use all services and systems available on the website you may be required to submit Account information or other Data.
You may restrict your internet browser’s use of Cookies. For more information see Section 10 below.

9.2 Accessing Your Data

You may access your Account at any time to view or amend the Data. You may need to modify or update your Data if your circumstances change. Additional Data as to your marketing preferences may also be stored and you may change this at any time.

You have the right to ask for a copy of your personal Data on payment of a small fee.

9.3 Opt-Out of Virgil

Use of Virgil is entirely voluntary. Every coaching exercise includes a manual alternative. You may complete the full course without ever interacting with Virgil, with no impact on your progress or completion status.

9.4 Deletion

You may request that we delete your personal information, including Virgil conversation data, by contacting us at support@humanskills.ai.

9.5 California Residents (CCPA/CPRA)

We do not sell your personal information. You have the right to know what personal information we collect, request its deletion, and not be discriminated against for exercising your privacy rights.

To exercise any of these rights, contact us at support@humanskills.ai. We will respond to verified requests within 45 days.

10. Cookies

HumanSkills.ai may set and access Cookies on your computer. A Cookie is a small text file placed on your computer when you visit certain parts of this website. Cookies allow us to identify recurring visitors and analyze browsing habits within the website.

You may restrict your internet browser’s use of Cookies. Doing so may affect the functionality of certain parts of the website.

11. Security

Data security is of great importance to HumanSkills.ai, and to protect your Data we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure Data collected online.

11.1 Virgil-Specific Security Measures

Virgil coaching data is stored in Google Cloud Platform (Firestore) within the United States with the following additional protections:
  • All data is encrypted at rest using Google Cloud’s default encryption
  • All data in transit is encrypted via TLS/HTTPS
  • Access to cloud infrastructure is restricted to authorized HumanSkills.ai personnel
  • Authentication tokens verify your identity for each coaching session
  • API keys and secrets are stored in Google Cloud Secret Manager

12. Changes to This Policy

HumanSkills.ai reserves the right to change this Privacy Policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the website and you are deemed to have accepted the terms of the Policy on your first use of the website following the alterations. We will notify active learners of material changes via the LearnWorlds platform or email.
